We invite comments on the proposed minimum price of 50 pence per unit which is set out in the draft Scottish Statutory Instrument at Annex A .
The Scotch Whisky Association (SWA) is the trade body for the industry with 68 members which comprises distillers, blenders and bottlers. The SWA has never commented on the price at which the MUP should be set. We do not believe it would be appropriate for us to do so. That is a decision for the Scottish Government to take based on its assessment of the evidence and objectives of the policy. The Supreme Court notes that MUP is experimental. Independent and objective evaluation of the policy will therefore be essential in assessing its effectiveness in reducing alcohol-related harms and its impact on the market and trade with third countries. It is unclear whether or not the price will be reviewed during the 5 year sunset provision period. If the price is reviewed, the evaluation will need to be able to accommodate any such changes. Similarly any further measures introduced to reduce alcohol-related harm over the same period would also require to be factored into the evaluation. It will be important to have the evaluation plan in place before MUP comes into force on 1 May 2018 setting out the key indicators against which the policy will be assessed.
