4. We would welcome comments on the draft partial Business and Regulatory Impact Assessment provided at Annex A.

Where there positive proof of failure to "honestly" reply to an "FOI" , the time scale for consideration by any Commissioner, male or female, will be such as to deter tenants in the first place. By the time a complaint is made and FOI requested, followed by evidence gathering period to prove the inaccuracy of the FOI, before we reach an appeal to a Commissioner, The issue which initiated the original complaint, could be an " established" part of the RSL's procedures and practices. All the tenant is likely to achieve in these circumstances is a feeble apology from the RSL and acknowledgement from a Commissioner. I would suggest that a tenant with such evidence should be able to "copy In" the Commissioner at the time the FOI is first challenged.

5. We would welcome comments on how these proposals might impact on ‘Equality Groups’ i.e. in respect of age, gender, race, religion, disability, sexuality, children’s rights etc. Comments will inform the Equalities Impact Assessment and Child Rights and Wellbeing Impact Assessment to be completed following consultation.

There should be no equality issues here.
