2. Freedom of Information can be extended to organisations that undertake ‘functions of a public nature’. You may wish to provide comments on how you consider that RSLs undertake functions of a public nature, for example, with reference to the factors referred to earlier in the consultation paper.

Orkney Islands Council believes that social landlords provide services of a public nature because: • The Local Housing Strategy is developed by the Council in consultation with Orkney Housing Association Limited (OHAL). Consequently OHAL deliver a number of services including new build developments and work in partnership with the Council in letting social housing to support the Strategy. • The Scottish Government’s funding for new builds, including OHAL properties, is agreed through the Council’s Strategic Housing Investment Plan and consequently they are in receipt of public money. • The Council and OHAL, in common with most other Council districts, have a common housing register and the two work together to support the same client groups. • They are subject to the same regulatory regime as the Council as they are classified as a social housing provider.

3. The proposed order would be expected to come into force on 1 April 2018. Do you consider this a reasonable timescale, allowing for preparation for inclusion?
