1. Do you agree that freedom of information legislation should be extended to Registered Social Landlords, as proposed in this consultation paper?

2. Freedom of Information can be extended to organisations that undertake ‘functions of a public nature’. You may wish to provide comments on how you consider that RSLs undertake functions of a public nature, for example, with reference to the factors referred to earlier in the consultation paper.

Many RSL s are small community based organisations with relatively small staff teams therefore adding another cost burden to local people. Most if not all of the information about our organisation can easily be found on our web site, annual accounts are published, annual report, report card, newsletters and the SHR holds a vast amount of statistical, operational, contextual and performance information all of which is in the public domain and easily accessible. We believe that the extension of FOI to housing associations places an unnecessary burden on us.

3. The proposed order would be expected to come into force on 1 April 2018. Do you consider this a reasonable timescale, allowing for preparation for inclusion?

We believe that housing associations should be given time to prepare governing bodies and staff with appropriate training. We need time to develop systems and procedures to ensure we comply with the FOI timescales and set conditions.

4. We would welcome comments on the draft partial Business and Regulatory Impact Assessment provided at Annex A.

Comments:
It would appear that the Scottish Government is determined to extend FOI to cover housing associations despite the fact that we are aware of no evidence of our sectors tenants having any issue in comparison to local authority tenants.

5. We would welcome comments on how these proposals might impact on ‘Equality Groups’ i.e. in respect of age, gender, race, religion, disability, sexuality, children’s rights etc. Comments will inform the Equalities Impact Assessment and Child Rights and Wellbeing Impact Assessment to be completed following consultation.
