2. Freedom of Information can be extended to organisations that undertake ‘functions of a public nature’. You may wish to provide comments on how you consider that RSLs undertake functions of a public nature, for example, with reference to the factors referred to earlier in the consultation paper.

RSLs for the majority have tenants sitting on the Board or Management Committee. Local authorities have far more hidden processes and functions such as (poorly maintained) roads, education, social care and administration. An RSL is responsible to its tenants and anyone buying services from it, whereas a local authority is wholly different being accountable to visitors, residents and the taxpayer.

3. The proposed order would be expected to come into force on 1 April 2018. Do you consider this a reasonable timescale, allowing for preparation for inclusion?

4. We would welcome comments on the draft partial Business and Regulatory Impact Assessment provided at Annex A.

Comments:
If one request might take 7 hours (!) to deal with, quoting your 2012 research, then the time impact could potentially be immense. Many RSL employ between 15-30 staff for which a days work to answer a single request is dis-proportionate and not sustainable. Instead the housing regulator should regulate publishing information that it is advised the public wish to see.

5. We would welcome comments on how these proposals might impact on ‘Equality Groups’ i.e. in respect of age, gender, race, religion, disability, sexuality, children’s rights etc. Comments will inform the Equalities Impact Assessment and Child Rights and Wellbeing Impact Assessment to be completed following consultation.

Statistics are already produced by the SHR to inform about equality. Hence FOI will add very little new information.
