There is very little available data on the number of SLAPPs (Strategic Lawsuits Against Public Participation) in Scotland or indeed the UK. SLAPPs are frequently compared to an iceberg: those cases which make it to court are identifiable and to some extent measurable but these represent only the ‘tip of the iceberg’. Far harder to measure, but considered to be more common, are the cases which result in some form of self-censorship and which do not reach the courts.
