We sought views on a proposed work programme and sustainability appraisal on reviewing and extending permitted development rights (PDR) in Scotland.  The consultation ran from 5 November 2019 and closed on 28 January 2020. PDR remove the need to apply for planning permission in certain circumstances as set out in the Town and Country Planning (General Permitted Development) (Scotland) Order 1992.  The sustainability appraisal covered 16 development types with the proposed work programme set out over several phases.

A total of 113 submissions were received - 61 responses from group respondents and 52 from individuals.  Comments were received on the proposed work programme, accuracy and scope of information, predicted effects and on mitigation and monitoring,

Overview

This consultation seeks views on the Scottish Government’s Proposed Work Programme, and associated Sustainability Appraisal (SA) report, for reviewing and extending permitted development rights (PDR) in Scotland.

The independent review of the planning system recommended exploring options for reviewing and extending PDR. Heads of Planning Scotland advised that there was scope to do so and Scottish Government commissioned consultants to undertake a SA to consider potential changes to PDR across 16 development types.

The Sustainability Appraisal report demonstrates that changes and extensions to PDR for a range of different development types have the potential to deliver significant positive impacts on Scotland's environment, economy and society and to contribute to the delivery of a range of Scottish Government priorities.

Why your views matter

We are inviting comments on both the Proposed Work Programme and the SA report by asking specific questions set out here and in Annex A of the Proposed Work Programme. This is directed at the general public, planning authorities, industry/businesses and those bodies and groups with particular interests. Responses will be analysed and will assist in taking forward this phased programme of work.

What happens next

Following this period, the consultation responses on the Proposed Work Programme and the SA will be analysed. Responses will be taken into account in the identification of PDR changes to be taken forward. This will provide opportunities for further stakeholder engagement and public consultation on specific changes to PDR before they are finalised.
