Freedom of Information (Scotland) Act 2002: 'Time for Compliance' Regulations

Consultation took place between March and May 2016 on Time for Compliance Regulations intended to take into account school holiday periods - in respect of grant-aided and independent special schools - when responding to FOI requests.
The consultation response paper considers the responses made to the consultation and sets out the Government's formal response.
The Government intends to bring forward Regulations as proposed, which, subject to Parliamentary approval, will come into effect on 1 December 2016. However, the Government also proposes to amend the Section 60 Code of Practice to emphasise the importance of responding promptly to FOI requests, irrespective of the Regulations.

Overview
This consultation arises directly from consultation in 2015 on extending coverage of the Freedom of Information (Scotland) Act 2002 to various organisations, including grant-aided schools and independent special schools.
The consultation sets out proposals on addressing issues of practicality for such schools by proposing to bring forward 'time for compliance' regulations to take into account school holiday periods in responding to FOI requests.

What happens next
