THE ROAD WORKS (QUALIFICATIONS OF OPERATIVES AND SUPERVISORS) (SCOTLAND) REGULATIONS 2019 – CONSULTATION ON AMENDMENTS

The New Roads and Street Works Act 1991 outlines a requirement for undertakers to have qualified supervisors and operatives on site while road works are in progress, Specifically, that “the execution of the works is supervised by a person having a prescribed qualification as a supervisor” and that “there is on site at all times when any such works are in progress at least one person having a prescribed qualification as a trained operative”.

The current instrument lists three specific bodies which can act as an awarding body in Scotland. Awarding bodies under these regulations are approved to provide training and issue certificates in road works. Recently, a fourth organisation, “Lantra”, has sought approval to be added to this list. The regulation above is being made in exercise of powers conferred by section 126(4) of the New Roads and Street Works Act 1991. Its purpose is to amend the existing 2017 Regulations to include “Lantra” as a new awarding body in section 8 (1).
