1. Should the provisions in the current Licensing (Procedure) (Scotland) Regulations 2007, specifically relating to neighbour notifications, be updated?

Are the current provisions relating to neighbour notifications fit for purpose? In what way should parts relating to neighbour notifications be amended? What would be the likely impact for local communities, the trade and the public?
The definition of neighbours should be widen to include immediate local residents, resident groups and the local community council

The well being of Local residents must be paramount and should given due consideration well above trade especially in areas where there are a lot of public houses (overprovision)

Are the other provisions fit for purpose? In what way should any of the other provisions be amended? What would be the likely impact for local communities, the trade and the public?
When local ordinary people present their views/objection at the meeting of the Licensing Board, they are at disadvantage because the applicants/traders has legal representation.

Also it would appear that some licensing Boards are timid and feel intimidated by top lawyers. When the Members of the Board adjourn to make a decision in private that always come back and declare that they are in favour of the application which is the granted.

Appeal procedure for local group should be revamped so that the procedure is less costly and they can have access to legal representation
