Implementing the prohibition of the sale and supply of single-use vapes in Scotland: your views

Closes 14 May 2024

Opened 2 Apr 2024

Overview

The Scottish Government, along with the UK Government and the Welsh Government, are proposing to introduce a prohibition on the sale and supply of single-use vapes (hereafter referred to as a ban on single-use vapes).

We have gathered views on our approach to this legislation through the consultation on Creating a smokefree generation and tackling youth vaping which ran from Oct-Dec 2023. The government response to this consultation can be found online.

We held a two-week technical consultation from 23rd February 2024 to 8th March 2024 on the draft Environmental Protection (Single-use Vapes) (Scotland) Regulations 2024 that would give effect to a ban. Following that consultation we have made updates to the definition of a single-use vape and enforcement powers. The finalised Regulations are published alongside this consultation.

This final six-week consultation invites feedback on the implementation of the ban and draft impact assessments, including a Strategic Environmental Assessment.

If you provided feedback on the impact or implementation of the ban during the previous consultation it will be taken into account, and there is no need to resubmit feedback to this consultation unless you have additional comments.

Useful information about responding to this consultation

As you complete your response, each page will provide the option to 'Save and come back later' at the bottom. This means you can save your progress and return to the consultation at any time before it closes. If you don't use this feature and leave the consultation midway through, your response will be lost.

Once you have submitted your response, you can enter your email address to get a pdf copy of your answers sent to you.

On the 'About You' page at the end of this consultation, organisations will have the opportunity to tell us more about their work and/or how their response was informed.

After the consultation has closed there will be a few months delay before any responses are published. This is because we must check any responses to be published abide by our Terms of Use.

A analysis report will usually be published some months after the consultation has closed. This report will summarise the findings based on all responses submitted. It will be published on the Scottish Government website and you may be notified about it if you choose to share your email address with us. You can also join our consulation mailing list where we regularly list newly published analysis reports (as well as new consultations).
