Background

The Transport (Scotland) Act 2005 (“the 2005 Act”) created new statutory provisions for the co-ordination of road works in Scotland and for the co-operation between road authorities and utility undertakers of works based on their obligations under the “New Roads and Streets Works Act 1991”. This included placing the Scottish Road Works Register (“the Register”) within statute.

Part 2 of the 2005 Act created the post of the Scottish Road Works Commissioner (The “Commissioner”) and requires that the Commissioner be the keeper of the Register, to allow road authorities and utilities to enter the prescribed notices required for their works in the road network.

The Register is funded through the collection of statutory fees and amounts from the community that uses it.
