Overview

This consultation is regarding the transfer of the Mental Health Tribunal for Scotland to the Scottish Tribunals in terms of the Tribunals (Scotland) Act 2014. This consultation covers:

(1) the Transfer of Functions and Members of the Mental Health Tribunal for Scotland to the Scottish Tribunals;

(2) the rules of procedure for the First-tier Tribunal for Scotland Mental Health Chamber;

(3) the rules of procedure for the Upper Tribunal for Scotland when hearing cases from the First-tier Tribunal Mental Health Chamber

(4) the Composition of the First-tier and Upper Tribunals for Scotland;

(5) the Eligibility for Membership of the First-tier Tribunal for Scotland Mental Health Chamber; and

(6) time limits for seeking permission to appeal a decision of the First-tier Tribunal for Scotland Mental Health Chamber.

Why We Are Consulting

This consultation document seeks to gather views on the transfer of the Mental Health Tribunal for Scotland (MHTS) into the First-tier Tribunal Mental Health Chamber of the Scottish Tribunals.

The consultation seeks views on draft regulations regarding the transfer of functions and members of the MHTS into the Scottish Tribunals, the rules and procedure of the Mental Health Chamber of the First-tier Tribunal, the rules and procedure of the Upper Tribunal when hearing cases from the First-tier Tribunal Mental Health Chamber, the composition of the First-tier and Upper Tribunals for Scotland, the eligibility for membership of the First-tier Tribunal, and the time limits for seeking permission to appeal a decision of the First-tier Tribunal Mental Health Chamber.
